1. Acceptance of Terms

By using the XTV Graphics service, a product of Sfera Films di Simone Sciutto, the user agrees to be bound by these Terms of Service. In these Terms of Service, the terms 'XTV Graphics' and 'we' refer to Sfera Films di Simone Sciutto. If you do not agree to these terms of service, you may not use the service.

2. Description of the Service

XTV Graphics is a CMS (Content Management System) designed for managing textual and image content for television graphics. The system allows the creation and management of custom databases, supports multi-user access, and data synchronization.

3. User Account

To use the service, you must create an account. The user is responsible for maintaining the confidentiality of their account credentials and for all activities conducted with it.

4. Subscription Plans and Billing

XTV Graphics offers various paid subscription plans with additional features:

  • Paid Plans: Offer advanced features, a greater number of configurable tables, extended storage capacity, and other premium features.

Payment Details

  • Payments for paid plans must be made in advance for the selected subscription period (monthly or yearly).
  • Fees are non-refundable unless otherwise stated in the specific subscription plan.
  • Failure to pay applicable fees will result in the suspension or termination of access to the service.
  • Payments and subscription management are handled through the Stripe service. By using XTV Graphics, you agree to the Stripe terms and conditions
  • You can connect to the Stripe portal by entering your registration email. Stripe will send an email with a link to connect to the customer portal, where you can cancel, downgrade, or upgrade the service.

Trial Period

Each paid subscription includes a one-month trial period during which the user can test the subscription and cancel without paying.

Offers and Discounts

Subscriptions can be sold with offers that allow for a discount, applicable within the expiration date specified at the time of the offer. Once the service is purchased with the discount, the discount will be applicable for the period specified in the offer (e.g., for one year), unless otherwise indicated at the time of purchase.

5. Permitted Use

The user agrees to use the service solely for lawful purposes and in compliance with all applicable laws and regulations. It is prohibited to:

  • Use the service for illegal or unauthorized activities.
  • Attempt to gain unauthorized access to the system or other accounts.
  • Use the service in a way that could damage, disable, or compromise the functionality of the service.

6. Intellectual Property

All rights, titles, and interests in the XTV Graphics service, including, but not limited to, software, trademarks, content, and design, are the exclusive property of Sfera Films di Simone Sciutto or its licensors. It is prohibited to copy, modify, distribute, or create derivative works based on the service without written authorization.

7. Limitation of Liability

XTV Graphics shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the service. In no event shall the total liability of XTV Graphics exceed the amount paid by the user for the service in the preceding 12 months.

Modifications to Subscription Plans

XTV Graphics reserves the right to modify, suspend, or terminate any subscription plan, including those offered with permanent discounts. In such cases, users who wish to continue using the service will need to subscribe to a new plan under the current terms and prices. Users will be notified at least 30 days in advance in case of substantial changes to their current subscription plans.

9. Termination

XTV Graphics may suspend or terminate the user's access to the service in case of violation of these Terms of Service. The user may terminate their account at any time by sending written notice to XTV Graphics. The user can connect to the Stripe portal by entering their registration email. Stripe will send an email with a link to connect to the customer portal, where the service can be canceled, downgraded, or upgraded.

10. Governing Law

These Terms of Service are governed by and interpreted in accordance with the laws of Italy. Any dispute arising from or relating to these terms will be subject to the exclusive jurisdiction of the competent courts of Genoa, Italy.

12. License

XTV Graphics grants the user a revocable, non-exclusive, non-transferable, and limited license to use the website strictly in accordance with the terms of this Agreement.

14. Refund Policy

XTV Graphics is committed to providing customers with the highest level of satisfaction. However, since each subscription includes a one-month trial period during which the user can test the subscription and cancel without paying, the refund policy is not applicable.

15. User Suggestions

Any feedback, comments, ideas, improvements, or suggestions (collectively, 'Suggestions') provided by the user to XTV Graphics regarding the website will remain the exclusive property of XTV Graphics. XTV Graphics will be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or compensation to you.

This Agreement constitutes the entire agreement between you and Sfera Films di Simone Sciutto regarding the use of the website and supersedes all prior and contemporaneous written or oral agreements between you and XTV Graphics. 26. Changes to Terms of Service

XTV Graphics reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use XTV Graphics.
